Terms of Service

1. Acceptance of Terms

By accessing and using BragBin.Com ("Service"), you accept and agree to be bound by the terms and provision of this agreement.

2. Service Description

BragBin provides photo digitization services, including mail-in service for physical photos and digital upload capabilities. Our service includes scanning, digitization, and delivery of digital copies of your photos.

3. Mail-In Service Terms

3.1 Batch Limits and Scope

Batch Limit: Mail-in service accepts up to 50 items per batch. Customers may send multiple batches if they have more than 50 items. Each batch is processed and billed separately.

Scope: Our current service handles loose prints (3x5–5x7 standard photo sizes). The following items are excluded from standard service:

  • Photo albums (bound or unbound)
  • Negatives and slides
  • Fragile or damaged items requiring special handling
  • Oversized prints (larger than 8x10)
  • Non-standard formats (polaroids, instant photos, etc.)

Excluded items may be available as add-on services with separate pricing. Contact us before shipping excluded items.

3.2 Shipping and Handling

Outbound Shipping: You are responsible for shipping your photos to us. We recommend using USPS Priority Mail, FedEx, or UPS with tracking and insurance. Shipping risks, including loss or damage during transit to us, are assumed by you.

Return Shipping: Return shipping is included in the service price for "Scan & Return" orders. We use USPS Priority Mail with tracking. For "Scan & Destroy" orders, no return shipping is required.

Processing Time: Standard processing time is 5–7 business days from receipt of your package. Processing begins once we receive and inventory your photos.

3.3 Scan & Destroy Service

Explicit Written Consent Required: The "Scan & Destroy" service requires explicit written consent acknowledging that:

  • Once destroyed, photos cannot be recovered
  • Destruction is permanent and irreversible
  • You understand and accept the risks
  • You have the legal right to authorize destruction of these photos

Consent must be provided via signed consent form included in your package or through our electronic consent process. We will not proceed with destruction until written consent is verified.

Certificate of Destruction: Upon completion of destruction, we provide a Certificate of Destruction documenting the date, method, and operator. This certificate is available for download from your order page.

3.4 Liability and Disclaimers

Liability Cap: Our liability for any claims related to the service is limited to the fees you paid for that specific service order. This includes, but is not limited to, loss, damage, or destruction of photos.

Sentimental Value Disclaimer: We disclaim all liability for sentimental value, emotional distress, or any non-monetary value associated with your photos. We cannot and do not guarantee the preservation of sentimental value.

Shipping Risks: You assume all risks associated with shipping photos to us, including loss, damage, or delay during transit. We recommend purchasing shipping insurance for valuable or irreplaceable items.

Processing Risks: While we take reasonable care in handling your photos, we disclaim liability for damage that may occur during normal processing, including but not limited to scanning, handling, or storage.

4. User Accounts

You are responsible for maintaining the confidentiality of your account and password. You agree to accept responsibility for all activities that occur under your account.

5. Privacy

Your use of the Service is also governed by our Privacy Policy. Please review our Privacy Policy, which also governs your use of the Service.

6. Limitation of Liability

BragBin shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including without limitation, loss of profits, data, use, goodwill, or other intangible losses, resulting from your use of the Service.

7. Changes to Terms

We reserve the right to modify these terms at any time. We will notify users of any changes by posting the new Terms of Service on this page.
